Terms of Service

1. Acceptance of Terms

By accessing or using SafeCardVault ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

2. Description of Service

SafeCardVault provides a secure, PCI-compliant platform for businesses to collect and store payment card information from their customers. The Service uses provider-hosted vault technology to ensure that raw card data never passes through application servers.

3. Account Registration

  • You must provide accurate and complete registration information
  • You are responsible for maintaining the security of your account credentials
  • You must notify us immediately of any unauthorized access
  • We reserve the right to suspend or terminate accounts that violate these Terms

4. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You shall not:

  • Use the Service for any illegal or fraudulent purpose
  • Attempt to gain unauthorized access to the Service or its systems
  • Interfere with or disrupt the Service or servers
  • Use the Service to collect card data without proper authorization from the cardholder
  • Share access credentials with unauthorized parties

5. Payment and Billing

Use of the Service may be subject to fees as described in your service agreement. All fees are non-refundable unless otherwise stated.

6. Data Processing

We process payment card data on behalf of your business. You acknowledge that:

  • Card data is processed by our PCI DSS Level 1 certified vault provider
  • We store only masked metadata and token references
  • You are responsible for obtaining proper consent from your customers
  • You must comply with applicable data protection laws

7. Intellectual Property

The Service and its original content, features, and functionality are owned by SafeCardVault and are protected by international copyright, trademark, and other intellectual property laws.

8. Limitation of Liability

To the maximum extent permitted by law, SafeCardVault shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

10. Indemnification

You agree to indemnify and hold harmless SafeCardVault from any claims, losses, damages, liabilities, and expenses arising out of your use of the Service or violation of these Terms.

11. Termination

We may terminate or suspend your account immediately, without prior notice, for conduct that we determine, in our sole discretion, violates these Terms or is harmful to other users, us, or third parties.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the "Last updated" date.
